Episode V - The Cos Strikes Back

cosby2.jpgJustin from Comic Sacrifice (creator of House of Cosbys) has made a post on the Channel 101 message boards asking people who have a copy of HOC ep.5 to not release it. So, even though I have a copy of the episode in question, and was going to release it in a torrent, I will hold off. I don't want to get anyone in trouble! The Channel 101 staff have also released a statement on their main page.

In compliance with a cease and desist order from Bill C**by's attorney, all episodes of House of C**bys have been deactivated at Channel101.com.

We are aware that any threat of a lawsuit would be an empty one, but if the show really bugs Bill C**by, then what right do we have to interfere with his pursuit of happiness...

The crux of the lawyer's letter was the unfair use of Bill C**by's name and likeness. In an attempt to undo any damage we have done, Channel 101 hereby asks everyone reading this to forget Bill C**by. Forget his name, forget his face, forget that he exists.

I think it's a real shame that our culture has come to this point. My good friend Ed has also made a great post about the situation and why it is much more important than it seems.
What's really unfortunate, like others have said, is how common this sort of thing is becoming in our culture, and, worse yet, how much we are willing to accept it as "just the ways things are." On one level, this is just a guy trying to protect his image. But it goes much deeper than that. Cosby didn't send a "please remove this thing that offends me as a courtesy" letter, he sent a legally-baseless cease and desist. This is a perfect example of the rich and powerful abusing our legal system to control the culture. I'm sure his lawyer is an Intellectual Property expert, and he knows, all other things being equal, that if he took the case to court, he could not win. But he also knows the defendants would run out of money long before Cosby would. So, if Bill Cosby decides our culture would be better without embarassing depictions of him, he can wave a wand and make it so. These wands are waved every day, and each time we sit back and let it happen, our culture suffers. And each time it happens without a fight, it becomes more acceptable. Making fun of Cosby doesn't necessarily enrich the national dialogue tremendously, but each time this happens, we get closer to the day when it seems acceptable for Newt Gingrich, or Rupert Murdock, or George W. Bush to wave the wand for themselves. Everyone can see the harm in that, but by the time we get there, the precedent has been established.

Great White dies in captivity

The Monterey Bay Aquarium recently had another setback in their attempts to successfully house a great white shark in captivity. The aquarium staff's most recent aquisition, another small white shark, died after being transported to temporary a holding tank in Malibu. The shark was caught by a commercial fisherman off the coast of Huntington Beach, CA, but wouldn't eat once it was in captivity. Biologists from the aquarium didn't feel comfortable releasing it back into the wild because its eye was injured and they felt they still had a chance to save it. This is a definite bummer, and although the aquarium is getting some flack about this from other scientists and animal rights people, I don't think they should give up. Aquarium spokesmen Ken Peterson makes a good point...

"We know that when people see living animals up close they get more engaged with them, more emotionally attached to them... You have to see that level of attachment before you can motivate people to take the political action to save these creatures... Sharks are dying by the tens of millions a year worldwide, and the public has to cry out loud to save the sharks."

MISSING: Bill Cosby's sense of humor

cosbys.jpgApparently, a lawyer representing Bill Cosby contacted the folks over at Channel 101 with a cease and desist order for their awesome animated show House of Cosbys. Now all four original episodes are being taken offline (as of 5 pm, 6/28/05) and the fifth and final episode (which was shown at the monthly Cinespace screening) will not be available anywhere online. This is really a sad turn of events. You would think someone like Bill Cosby, who claims to be a comedian, would have a better sense of humor about something like this. Channel 101 is a non-commercial website and no one was making any money off Cosby's likeness (that I know of)... I submitted this to Boing Boing and they've put a link up, so hopefully someone will seed a torrent of the episodes (including number 5?) soon.

UPDATE: Behold the power of BoingBoing: torrent 1, torrent 2. Just episodes 1-4, though. No episode 5, yet.

Supreme Court screws American innovation

The Supreme Court handed down a unanimous decision in the Grokster case today. Unfortunately it was not the decision most people outside the Hollywood entertainment industry wanted to hear. Lots of people have lots to say about this decision, but I think Cory Doctorow has summed it up very well...

Just Steal It

Nike recently copied the design of a Minor Threat album cover for an ad promoting their Major Threat East Coast Skateboard Tour. Ian MacKaye, lead singer/songwriter of Minor Threat (and also Fugazi) released a statement through his label, Dischord Records, saying that Nike did not ask permission, and even if they had, he wouldn't have given it.

"[This is] just another familiar example of mainstream corporations attempting to assimilate underground culture to turn a buck. However it is more disheartening to us to think that Nike may be successful in using this imagery to fool kids ... into thinking that the general ethos of this label, and Minor Threat in particular, can somehow be linked to Nike's mission."
Nike certainly doesn't epitomized the DIY "ethos," so I guess it's no wonder Minor Threat fans are upset. Now I just wonder if Rancid got permission before they released ...And Out Come the Wolves.

UPDATE: Nike has issued a formal apology to Minor Threat and Dischord Records.

Go! Team album a no-go

I read today on Pitchfork that The Go! Team's album "Thunder, Lightning, Strike" has yet to be released here in the U.S. I was unaware of this, since it is readily available on the iTunes music store. The album is really great, and it's a shame it hasn't gotten a proper U.S. release yet. Apparently, the problem stems from getting a few of the album's numerous samples cleared. Go! Team leader Ian Parton has an interesting quote in the story which really got my attention...

"I might actually be giving away more of the song than I own. If 10 people want 15%, then that is over 100%, and I have to get the money from other songs, which is a ridiculous idea, that you have remake the loss on a song."
That's right! If one of his songs used numerous samples (which you realize is very likely, if you've heard their music) then The Go! Team could actulally lose money by releasing the song. If this doesn't show that artistic creativity is being stifled by the U.S.'s archaic copyright law, then I don't know what does.

The Bearfoot Hookers

My good friends The Bearfoot Hookers recently redesigned their website. they've also made both of their albums, Sweet Pickle Grits and Life at the Bar, available online as mp3s. Some of my favorite songs are "Ain't Got No Plans," "Songs Like You," "Gettin' Ready for the Show," and "I Feel Fine"... Of course, if you like the band, please buy their CDs and go see them on the road. The Hookers put on a great live show and they've got several gigs scheduled all over Georgia in the next couple of months. I drew this flier artwork for them a while back as well. Brewfest is homeless

The Classic Center in Athens recently sent a letter to the organizers of Brewfest telling them to find new digs for the annual beer festival. Check the letter out here. The Classic Center folks cite "the swelling popularity of the event, the increasingly poor behavior of certain Brewfest patrons" as a couple of reasons they no longer want to host it. While I'm disappointed to hear this, I have to say their concerns are probably justified. The crowd this year was huge, and it wasn't nearly as fun as years past. Still, it's too bad another Athens tradition is going the way of the dinosaurs. Owen Ogletree of Classic City Brew says the new plan is to "scale back the Brewfest in size and hold the 2006 event either indoors at a smaller venue or outdoors in a large downtown parking lot..."

Roger Clyne & The Peacemakers - Greenville, SC - 6/3/05This weekend I saw some really great live music. Friday Tang, Ed and I made a roadtrip to the Handlebar in Greenville, SC to see one of my favorite bands, Roger Clyne & The Peacemakers. If you're not familiar with their music, you should definitely check them out. Roger used to be the lead singer of a band called the Refreshments in the 90's. They broke up, but the Peacemakers still perform most of the old Refreshments songs, which is great, since Fizzy Fuzzy Big & Buzzy is probably my all time favorite album.

Rilo KileySunday, I went with several friends to see Rilo Kiley, a great band that's been getting some good press lately. They just signed to Warner Bros. so I don't expect the buzz to wind down any time soon. The band is anchored by co-lead singers Jenny Lewis and Blake Sennett, both of whom were childhood actors. Rilo Kiley's music is a little poppier than my normal tastes, but I can't seem to stop listening to them. Their live show was really great, ending with an acoustic cover of Pete Townshend's "Let My Love Open the Door"...on Ukulele! They are going to be playing in Athens on Wednesday, so go check them out if you're in the Classic City.

Atom Bombs and Blunt Razors

SpoonSpoon rocked the Variety Playhouse last night. The lead singer, Britt Daniel, is really the only person in the band with much of a personality, but that didn't seem to matter. If you get a chance, I suggest you see them.

Who owns Culture?

This is a great talk by Jeff Tweedy and Lawrence Lessig given at the New York Public Library back in April. I just heard it today, and it is especially interesting, as I just finished Lessig's book. It's available in both streaming audio and video, as well as audio and video torrents. Kottke liked it too. UPDATE: Cory liked it too, too.

Unleash the BATS!

According to Defense Tech, during World War II, the U.S. military planned to deploy squadrons of bats, strapped with explosives, to burn down the cities of Japan. This has to be one of the coolest things I've ever read. Why haven't I ever seen a special about this on the History channel?
